1. Agreement to Terms
These Terms of Service ("Terms", "Agreement") constitute a binding legal agreement between you ("User", "Licensee", "you") and Atlas Authentication, Inc. ("Atlas", "we", "us", "our"). By accessing, browsing, or using any Atlas Authentication services, platform, or products—including but not limited to our web authentication panel, client library, API endpoints, or protected applications—you acknowledge that you have read, understood, and agree to be legally bound by all terms, conditions, and policies contained herein.
If you are using Atlas services on behalf of a company, organization, or entity, you represent and warrant that you have the legal authority to bind that entity to this Agreement. If you do not have such authority or do not agree to these terms, you are prohibited from using our services.
These Terms apply to all users regardless of account type: individual developers, enterprise organizations, resellers, partners, trial accounts, and end-users of applications protected by Atlas Authentication. Different account types may have additional terms specified in your specific service agreement or order confirmation.
2. Service Description and Limitations
2.1 What Atlas Provides
Atlas Authentication provides a comprehensive software protection and license management platform consisting of:
- Client Library: A lightweight integration library for C++ applications implementing license validation and anti-tampering protection
- Authentication API: Cloud-based authentication endpoints validating license keys and responding to authentication requests from protected applications
- Web Administration Panel: A dashboard for license management, user creation, analytics, and account administration
- Real-Time Monitoring: Behavioral analysis systems detecting unauthorized use, hardware changes, and license violations
- Hardware Binding: License enforcement tied to specific hardware configurations preventing illegal sharing and distribution
2.2 Service Availability
Atlas Authentication maintains approximately 95% uptime on a 30-day rolling average. Scheduled maintenance windows may occur during off-peak hours with advance notice. We do not guarantee 100% uptime. Downtime resulting from factors beyond our reasonable control (third-party provider outages, natural disasters, government actions) does not constitute a service breach. During service interruptions, you may not be able to authenticate users or validate licenses.
2.3 Performance Specifications
- Authentication response time: 100ms average (measured from request submission to response delivery)
- Supported concurrent authentications: Unlimited (scales horizontally across infrastructure)
- API rate limits: 1000 requests per minute per API key (burst capacity 10,000 requests per minute)
- Hardware fingerprint accuracy: Database matching against enrolled hardware configuration
2.4 Service Limitations
Atlas services are provided on an "AS-IS" basis. We do not guarantee that our services will be error-free, uninterrupted, or that vulnerabilities will never be discovered. No software system is perfectly secure. While we employ industry-leading security practices, we do not warrant that our services are impenetrable or unhackable. We continuously patch vulnerabilities as discovered but cannot guarantee zero-day protection.
3. User Account Responsibilities
3.1 Account Creation and Security
You are responsible for maintaining the confidentiality of your username, password, and any API keys issued to your account. You are fully liable for all activities conducted using your account credentials. If you suspect unauthorized access to your account:
- Change your password immediately
- Notify Atlas security team at security@atlassecurity.site
- Provide detailed information about suspected unauthorized activity
3.2 Account Information Accuracy
You certify that all information provided during account registration and in your account profile is accurate, current, and complete. You agree to update your account information promptly if any details change. False or misleading information may result in account termination without refund. This includes but is not limited to:
- Real legal name or company name
- Valid contact email address
- Accurate billing address
- Truthful information about intended use
3.3 Prohibited Account Activities
You agree not to:
- Share your account credentials with other individuals
- Create multiple accounts to circumvent rate limits, purchase restrictions, or licensing terms
- Use accounts for purposes other than those disclosed at registration
- Attempt to gain unauthorized access to our systems or other user accounts
- Use account access to extract confidential information or data belonging to other users
- Conduct any form of fraud, including refund fraud, payment fraud, or license fraud
4. License Grant and Restrictions
4.1 Limited License Grant
Subject to full payment and compliance with these Terms, Atlas grants you a non-exclusive, non-transferable, revocable license to:
- Use our client library in your applications
- Access our authentication API to validate licenses in production applications
- Manage licenses through our web administration panel
- Integrate our services for authorized business purposes
Licenses are purchased for specific time periods (3 months, 6 months, or 12 months from activation date) and grant rights only during the active license period. Upon expiration, all license rights terminate and licenses must be renewed to continue service.
4.2 Hardware Binding and Non-Transferability
Licenses are bound to specific hardware configurations through cryptographic hardware fingerprinting. Each hardware binding:
- Covers up to 10 hardware identifier types (CPU serial, motherboard ID, BIOS ID, disk serial, MAC address, GPU ID, system UUID, physical volume identifiers, firmware version, and manufacturer data)
- Cannot be transferred between devices: Attempting to activate a license on unauthorized hardware triggers immediate suspension
- Allows legitimate upgrades: Minor system upgrades (RAM, storage) may be detected as same hardware; major changes (CPU, motherboard) are treated as new hardware and require license re-binding
- Permits corporate environments: Enterprise users may request multiple hardware bindings per license for multi-workstation deployments (at Atlas discretion)
4.3 Concurrent Session Limits
Each active license supports a maximum number of concurrent authenticated sessions determined by the license tier:
- Standard License: 1 concurrent user session
- Professional License: 3 concurrent user sessions (for organizational use)
- Enterprise License: Unlimited concurrent sessions (for enterprise deployments)
Attempting to exceed concurrent session limits results in automatic termination of the oldest session. Deliberately attempting to exceed limits through technical means may trigger account suspension for license violation.
4.4 Restrictions on Use
You are strictly prohibited from:
- Reverse Engineering: Attempting to reverse engineer, decompile, or disassemble our client library, API, or authentication protocol
- License Sharing: Sharing, distributing, or lending your license key to other individuals or entities. Each license is valid only for the original purchaser
- License Cloning: Duplicating or attempting to duplicate hardware fingerprints to activate one license on multiple machines
- Tampering: Modifying, patching, or attempting to bypass our authentication protocol, client library, or protection mechanisms
- Cracking: Attempting to crack, patch, or circumvent hardware binding validation
- Unauthorized Distribution: Distributing protected applications with valid licenses to end-users not authorized by the license agreement
- API Abuse: Submitting requests to exceed rate limits, conducting automated scanning, or using APIs for purposes not explicitly authorized
- Impersonation: Misrepresenting yourself or your intended use to obtain a license under false pretenses
5. Fees and Payment Terms
5.1 Pricing and Payment
License prices are displayed in United States Dollars (USD). Payment can be made through:
- PayPal (converted to USD if needed)
- Cryptocurrency (Bitcoin, Ethereum, specified cryptocurrencies accepted at current market rates)
- Bank transfer for enterprise accounts (requires minimum purchase and credit review)
All prices are subject to change without notice. Changes take effect at your next subscription renewal or when you purchase additional licenses. Previously quoted prices are not honored for future purchases.
5.2 Billing Cycle and Renewal
Licenses are billed upfront for the selected period (3, 6, or 12 months). Licenses automatically expire at the end of the billing period. We will send expiration reminders 30 days and 7 days before expiration. Renewal is not automatic—you must manually renew through your account to maintain service.
5.3 Taxes and Additional Fees
You are responsible for all applicable taxes, including sales tax, VAT, GST, and other transaction taxes based on your jurisdiction. We will collect and remit taxes as required by law. Bank transfer fees or cryptocurrency conversion fees (if applicable) may be charged to your account as a separate line item.
5.4 Failed Payments
If a payment attempt fails or is declined, we will attempt to retry the payment up to 3 times using stored payment information. If all retry attempts fail, your account will be flagged for manual review. Repeated failed payments may result in temporary account suspension until payment is resolved.
6. Refunds and 30-Day Money-Back Guarantee
6.1 Money-Back Guarantee Period
Atlas provides a 30-day money-back guarantee from the date of purchase. This guarantee applies to initial purchases only and allows customers dissatisfied with our service for legitimate reasons to request a full refund of the license fee.
6.2 Refund Eligibility Criteria
Refunds are granted only when ALL of the following conditions are met:
- Refund request is submitted within 30 calendar days of initial purchase date
- License was not used to distribute protected applications to end-users commercially
- Requestor is the original purchaser whose payment method is on file (no transfers or resales)
- No fraudulent activity is associated with the account
- License has not been shared or activated on unauthorized hardware
- No technical support issues have been escalated to Atlas security team
- Account has not been flagged for behavioral anomalies or unusual access patterns
6.3 Refunds NOT Granted
Atlas does not grant refunds in the following circumstances:
- License Violations: License was shared, distributed, or used on unauthorized hardware
- Reverse Engineering Attempts: Any attempts to reverse engineer, crack, or modify our authentication system
- Fraud Detection: Account flagged for fraud, chargebacks, or false claims
- Security Violations: Multiple failed authentication attempts from suspicious geographic locations
- Impersonation or False Information: Account information was false or license was obtained under pretenses
- Renewal Purchases: Refunds on license renewals or upgrades (not initial purchases)
- Time-Based Exclusion: Refund request submitted more than 30 days after purchase
- Feature Misunderstanding: Refund requested because certain features don't work as expected (user error)
- Prior Usage: License has been actively used for more than 15 days (demonstrates acceptance of service)
- After First Abuse Detection: If account triggers abuse detection systems, refund eligibility terminates
6.4 Anti-Fraud Refund Verification
To prevent refund fraud, Atlas conducts thorough verification:
- We analyze authentication logs to confirm actual service usage
- We investigate payment patterns to identify fraudulent refund requests
- We check for chargebacks or disputes on the original payment method
- We flag accounts attempting multiple refund requests as ineligible
- If refund abuse is detected, all future refunds are permanently denied
6.5 Refund Processing
Approved refunds are issued to the original payment method within 10 business days of approval. PayPal refunds typically appear within 3-5 business days; cryptocurrency refunds may take up to 2 business days for network confirmation; bank refunds may take up to 10 business days.
6.6 No Refund for Early Expiration
We do not provide refunds if you fail to renew a license before expiration. You are responsible for tracking your license expiration dates and initiating renewal before the expiration date. License expiration notifications are sent at 30 days and 7 days before expiration.
7. Prohibited Activities and Enforcement
7.1 Prohibited Uses
You agree that you will not use Atlas services to:
- Distribute protected applications without proper licensing agreements with end-users
- Facilitate software piracy, cracking, or redistribution of copyrighted materials
- Impersonate other parties or misrepresent your identity
- Engage in illegal activities or violate applicable laws
- Conduct denial-of-service attacks, credential stuffing, or other attack vectors
- Disrupt or interfere with our systems, services, or infrastructure
- Violate intellectual property rights of any party
- Process payment through stolen, fraudulent, or unauthorized payment methods
7.2 Violation Detection and Monitoring
Atlas employs automated systems monitoring for violations:
- Hardware Fingerprint Analysis: Detects when one license key activates on multiple hardware configurations
- Geographic Anomaly Detection: Flags impossible travel (authentication from distant locations within physically impossible timeframes)
- Concurrent Session Monitoring: Alerts when session limits are exceeded or shared licenses are detected
- Behavioral Analysis: Identifies suspicious patterns including brute force attempts, automated scanning, and unusual access times
- Fraud Detection: Automated systems flag suspicious refund requests, chargebacks, and payment anomalies
7.3 Account Suspension and Termination
Atlas reserves the right to immediately suspend or terminate your account if:
- You violate any material term of this Agreement
- Your account is flagged for fraudulent activity, including refund fraud
- Your license is detected on unauthorized hardware
- You engage in reverse engineering or tampering with our systems
- You conduct attacks or security testing without express written authorization
- You share your license with other parties
- Multiple chargeback attempts are initiated against your account
Upon account suspension or termination:
- All licenses are immediately deactivated and cease functioning
- No refunds are provided for unused license time
- Account information is retained for fraud investigation and legal purposes
- Re-registration with a new account may be permanently prohibited
- We may pursue legal action for damages if applicable
8. Intellectual Property Rights
8.1 Atlas Intellectual Property
All aspects of Atlas Authentication services are protected intellectual property:
- Client library code and implementation
- Authentication protocol design and algorithms
- Custom stream cipher and cryptographic implementations
- Hardware fingerprinting methodology
- Web interface design and functionality
- Documentation, manuals, and supporting materials
- Trademarks, logos, and branding
These materials are licensed to you for use solely as permitted by this Agreement. You obtain no ownership interest in any intellectual property.
8.2 User Content License
Any content you submit to Atlas (feedback, bug reports, feature requests, support tickets) grants us a perpetual, worldwide, royalty-free license to use that content for service improvement and development without attribution or compensation.
8.3 Copyright and DMCA
Atlas services are designed to protect intellectual property of software developers. If you believe someone is infringing your copyrights through use of our service, send a DMCA notice to dmca@atlassecurity.site with:
- Description of copyrighted work
- Description of infringing use
- Your contact information and statement under penalty of perjury that you are the copyright owner
- Link to or specific identification of infringing content
9. Limitations of Liability and Warranties
9.1 AS-IS Service Provision
Atlas services are provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, express or implied. We specifically disclaim:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of accuracy, completeness, or reliability of service
- Warranties of uninterrupted or error-free operation
- Warranties that vulnerabilities will not exist or be discovered
- Warranties that service will meet your specific requirements
9.2 No Guarantee of Security
While we employ industry-leading security practices, no software system is impenetrable. We do not guarantee that:
- Your data will never be compromised
- Our authentication system cannot be bypassed
- Hardware binding cannot be circumvented
- Zero-day vulnerabilities will not be discovered
You acknowledge these risks and agree to use our service with full knowledge that security is never absolute.
9.3 Liability Limitations
To the maximum extent permitted by law, Atlas is not liable for:
- Indirect Damages: Loss of profits, loss of business, lost data, or business interruption
- Consequential Damages: Any damages resulting from service interruptions or errors
- Incidental Damages: Any unforeseeable damages arising from service use
- Punitive Damages: Any damages intended to punish or deter conduct
TOTAL LIABILITY LIMITATION: Atlas's total liability for any claim, regardless of cause, does not exceed the amount you paid for licenses in the 12 months preceding the claim.
9.4 Service Interruption Liability
Atlas is not liable for service interruptions, downtime, or performance degradation caused by:
- Third-party provider outages (hosting, ISP, DNS providers)
- Natural disasters, acts of war, or government actions
- Denial-of-service or cyberattacks (beyond our control)
- User error or misconfiguration
10. Indemnification
10.1 Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless Atlas Authentication and its officers, directors, employees, agents, and successors from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
- Your violation of this Agreement
- Your use of our services to engage in illegal activities
- Your infringement of third-party intellectual property rights
- Your distribution of protected applications in violation of licensing terms
- Claims by end-users of your protected applications
- Any loss or damage to third parties resulting from your use of our service
11. Dispute Resolution and Governing Law
11.1 Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflicts of laws principles.
11.2 Informal Resolution
Before initiating formal legal proceedings, you agree to attempt informal resolution by sending a detailed written description of the dispute to disputes@atlassecurity.site. We will respond within 10 business days with our proposed resolution. If we cannot resolve the dispute, either party may pursue formal legal proceedings.
11.3 Jurisdiction and Venue
You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any legal proceedings arising from this Agreement. You waive any objection based on improper venue or forum non conveniens.
11.4 No Class Actions
YOU AGREE THAT DISPUTES MUST BE RESOLVED ON AN INDIVIDUAL BASIS. You waive the right to participate in any class action, class arbitration, or representative action against Atlas. All disputes must be brought in your individual capacity and not on behalf of any other person or entity.
12. Modifications to Terms
Atlas reserves the right to modify these Terms at any time. Material modifications will be posted on our website with at least 30 days' notice. Your continued use of our services after notification constitutes acceptance of modified terms. If you do not accept modifications, you must cease using our services.
13. Severability
If any provision of this Agreement is found to be unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.
14. Entire Agreement
This Terms of Service, together with our Privacy Policy and any order forms or service agreements, constitutes the entire agreement between you and Atlas regarding use of our services. All prior agreements, understandings, and negotiations are superseded.
